General Terms and Conditions for Gofinestera
Article 1 Definitions and Scope

In these general terms and conditions, the following definitions apply:
Participant/student/private individual: A natural person who has registered for a training program, course, lecture, trip or excursion organized by Gofinestera.
Activity: A training program, training course, lecture, trip or excursion organized by Gofinestera.
Organization: A legal entity that purchases one or more individual sessions, trips, or training programs from Splendid.
Costs: The fee owed by the participant or organization to Gofinestera. These costs are listed on the website for the relevant program.
Agreement: The completed registration form based on the information provided on the website for the relevant program, confirmed by email and an invoice specifying the services.
Gofinestera (or Gofinestera): The general partnership Gofinestera, established in Austerlitz (Chamber of Commerce 61276642). -
These General Terms and Conditions apply to all agreements between Gofinestera and students and/or participants of training programs, courses, and excursions, with the exception of organized trips.

Deviations from these conditions are only valid if agreed upon.
Article 2 Execution of the Agreement

Gofinestera reserves the right to cancel an activity or refuse participation, including (but not limited to) situations where the minimum number of participants is not met.

Gofinestera may decide not to admit a student or participant if it believes that the individual does not belong to the intended target group. No appeal is possible against this decision.

Gofinestera is entitled to have certain work carried out by third parties (including substituting instructors or external activities).

All information provided by participants or students to Gofinestera is treated confidentially.
Article 3 Registration and Placement

A private individual registers as a student or participant for the full activity.

A private individual is officially registered once the online registration form has been completed and submitted. After registration, the student/participant has a 14-day right of withdrawal during which the registration can be cancelled without giving any reason. This does not apply if this period (partly) falls after the start of the training.

For long-term training programs, a 50% deposit is required. If the course or training does not take place or if the registration is cancelled in time as described above, this amount will be refunded within one month. For short training courses of 12 lessons or fewer, the full amount must be paid in advance.

The participant receives an invoice once Gofinestera can guarantee that the activity will take place. At that moment the payment obligation becomes effective.

In case of non-payment, Gofinestera is entitled to suspend placement and deny the participant access. The payment obligation remains in all cases.

Participants registering for the Conscious People Training or the Master Conscious People must undergo an admission procedure in the form of an intake. After successful completion and confirmation by the participant, Gofinestera will confirm the registration.

For agreements with organizations, institutions, or companies, an intake will take place beforehand. Based on this, a quotation will be drawn up specifying: number of participants, scope of the project, content, objectives, costs, and evaluation. After signing the quotation by both parties or acceptance by the organization, the agreement is established and planning and execution will commence.
Article 4 Cancellation of the Agreement

Cancellation by a student or participant is possible free of charge up to 14 days before the start of the activity, provided this is done in writing. For cancellation between 14 days before the start and the start date itself, 50% of the total agreed price is owed.

In case of early termination by the participant after the activity has started, the full participation fee remains due.

If a participant ends the training/course upon advice of Gofinestera’s management, the management may decide to relax these payment conditions.

For cancellation of an individual appointment 48 hours or less before the scheduled time, the participant owes Gofinestera an amount equal to the consultation fee.
Article 5 Payment – General

For training programs, courses, excursions, and trips, all costs and conditions stated in the provided information on the website and in brochures are binding for both parties.

In case of late payment, the participant is legally in default without any notice of default being required. Any extrajudicial collection costs incurred by Gofinestera are payable by the participant. The applicable rates are those established by government regulation pursuant to Article 6:96 of the Dutch Civil Code.
Article 6 Confidentiality

All information provided by or about participants or students, whether before or during activities, and which can reasonably be expected to be confidential in nature, is treated as such by Gofinestera.

Participants and students must also treat information provided by fellow participants or students as confidential. What is discussed in class stays within the classroom.

Gofinestera instructors ensure a safe learning environment.
Article 7 Other Rights and Obligations

For the training programs, the obligations of effort for both parties, as described on the website of the relevant program, are binding.

Upon successful completion, the participant receives a certificate of participation.

New instructors commit to these General Terms and Conditions of Gofinestera.

The agreement for the training program is valid for the duration of the program.
-
For online training, the participant is responsible for the necessary equipment and accessories.
Article 8 Liability

The student or participant is responsible for determining whether they possess and maintain the physical and mental fitness required to follow the activity. Gofinestera is not liable for direct or indirect consequences of lacking such fitness. The student or participant indemnifies Gofinestera against potential liability from third parties, including (but not limited to) fellow students.

Gofinestera is only liable for damages suffered by the participant resulting from an attributable shortcoming in the execution of the agreement or from an unlawful act, and only up to the amount covered by its liability insurance, provided the insurer pays out.

Gofinestera is not liable for any psychological damage or physical injury arising during or after activities.

Gofinestera is not liable for loss, theft or damage of participants’ property or materials brought by them during activities or while present in the (class) premises.

Gofinestera’s liability is always limited to a maximum of the amount the participant has paid for the activity.
Article 9 Complaints Procedure

Complaints may be submitted in writing or by email to:

Receipt of the complaint will be confirmed in writing or by email within two working days.

The handling of the complaint is the responsibility of management.

All complaints are treated confidentially by both parties.

Within two weeks, a written or emailed proposal for resolution will be provided. If the complaint is not resolved satisfactorily, both parties will continue to seek an internal solution unless more than two months have passed since submission.

If no resolution is reached, the complainant has the option to appeal. Upon request, the complaint may be forwarded to mr. Ph.A. de Koningh (info@dekoningh-advocaat.nl), who will act as an independent assessor. The decision is binding.

Complaints are registered and kept for two years.
